Terms,
in plain words.
Last updated: October 21, 2026
1. Who we are, and who these terms are for
Candela (candela.mov) is a service of Dafin SA, route de Saconnex-d'Arve 131, 1228 Plan-les-Ouates, CHE-297.893.248 VAT (“we”, “us”). It makes branded product films, with the help of AI, from briefs, websites, screen recordings and other product material.
Candela is sold to businesses only: by creating an account or buying frames you confirm that you act for a company or as a self-employed professional, not as a consumer. These terms apply to every use of Candela unless a signed contract, such as an Enterprise agreement, says otherwise.
2. Definitions and your account
- You, the customer: the organisation that creates an account or buys frames. The people it invites (users) act on its behalf, and you are responsible for what they do in Candela.
- Owners manage the organisation, its members and its billing; members make and review films.
- Your material: everything you or your users provide or have Candela capture: briefs, texts, logos, websites, screens, screen recordings, Recorder captures and review notes.
- Output: the scripts, compositions, narration and films Candela makes for you. How making it uses frames is set out in section 3.
- Frames: the prepaid units with which films and actions (writing a film, AI edits, re-renders, voice, AI shots) are paid for.
- Keep sign-in details confidential, and give accurate company and billing details and keep them up to date. If you suspect that someone uses the organisation's account without permission, an owner removes them from the organisation at once.
3. Frames: packs, use and validity
- Frames are bought in advance, in packs paid once: Starter (100 frames for 40 USD), Studio (1,000 frames for 340 USD, 15% off) and Agency (5,000 frames for 1,500 USD, 25% off); one frame is 0.40 USD at list price. The same packs are sold in CHF and EUR, at the prices shown on the pricing and billing pages. There is no subscription. Seats are unlimited and brand kits are included. Prices are on the billing page, in the currency you choose, before you pay.
- Every film and action (writing the film, its plan included; AI edits; re-renders; voice; AI shots) uses frames by what it really costs to make, rounded up at the end of each film or action. An estimate (“about N frames, at most M”) is shown before every click.
- A film or action starts only if the balance covers its estimate. Its frames are reserved while it runs, and what it does not use comes back when it ends. This is not a refund: those frames were never used.
- A film or action that fails because of Candela (a crash, our infrastructure, our own limits) uses no frames. A film or action you stop uses what it used until then.
- The organisation's first film uses half its frames, once.
- Unused frames expire 6 months after the organisation's latest purchase. Every purchase, automatic renewals included, restarts this period for the whole balance, so the whole balance always expires on one date. We warn the organisation's owners 30 days before the balance expires. Expired frames are not refunded.
- Enterprise volumes and prices, dedicated installations, service levels and data processing agreements are set in a signed contract, which prevails over these terms.
4. Payment, auto-renewal and refunds
- Payments are processed by Stripe; Dafin SA is the seller and A-XIOM Solutions Sàrl issues the invoices. We never see your card number.
- A-XIOM Solutions Sàrl issues the invoices and collects payment for Candela: Checkout, your receipts, your invoices and your card or TWINT statement show that name. Your contract for Candela is with Dafin SA.
- Auto-renewal is off by default. It is chosen at sign-up, and an owner can switch it on or off at any time on the billing page. When it is on and the balance drops under its threshold (by default, one typical film), the same pack is bought again with the saved card. Switching it off stops future purchases; there is no subscription to cancel.
- If an automatic renewal fails, the organisation's owners are emailed and the billing page shows a banner. Until an owner updates the card or buys a pack, films and actions can use only the frames that are left.
- Unused frames are not refunded, including when auto-renewal is switched off, when the organisation is deleted or when you leave it, except where the law requires a refund; a payment made in error is refunded in full. See the refund policy.
- We may change pack prices with at least 30 days' notice to the organisation's owners. A new price applies to packs bought after the notice period, automatic renewals included; if you do not accept it, switch auto-renewal off.
5. Currency and taxes
- You choose to pay in USD, CHF or EUR, by card (or TWINT in CHF, when offered). Organisations in Switzerland and Liechtenstein pay Swiss VAT at 8.1% in every currency. Auto-renewal buys in the currency of your latest purchase.
- Organisations in the EU and the UK give a valid VAT number when they buy; the invoice is then reverse-charged (you account for the VAT). Without one, Candela is sold only under an Enterprise contract.
- Prices are shown before tax. Stripe calculates the tax on each invoice from the billing country and VAT number you give; you are responsible for giving correct details and for any tax you must account for yourself.
6. Your material
- You keep all rights in your material. You grant us a non-exclusive licence, for as long as your account exists, to use it only to make, store and deliver your films and to run the service.
- You confirm that you hold every right and permission needed for all the material you upload or have Candela capture, including third-party websites, screens and recordings, logos and trademarks, and the names, faces and voices of the people shown, and that using it breaches no one's rights, no contract and no law.
- Do not record screens that show real end-customer data unless you are allowed to; use a demo account where you can. Masking in the Recorder helps, but you remain responsible for what you capture.
- We do not use your material or your output to train AI models. Details are in the privacy policy.
7. AI-generated output
- Once the frames it used are paid for, the output made for you is yours: we assign to you whatever rights we hold in it, and you may use it for any lawful purpose. Licensed music, voices, fonts and stock elements stay under their providers' licences, which allow commercial use of the finished film.
- Films may be used online and offline, for example on websites and social media, in presentations, at events and in sales material. They may not be used in cinema, on broadcast television or radio, including as advertising in those channels, without a separate licence for the music they contain; for those uses, make a version without music or with music you have licensed yourself. You may not extract a film's music to use it on its own.
- AI can produce similar output for other customers: we do not guarantee that output is unique, or that it is protected by copyright in every country.
- Review every film before you publish it. You are responsible for the claims, figures and statements your films make and for how you use them.
- AI makes mistakes: output may be inaccurate, incomplete, out of date or unsuitable, even when it looks right. It is not legal, financial or other professional advice.
8. Acceptable use
Do not use Candela, or let anyone use it, to:
- impersonate a person or an organisation, or suggest an endorsement or affiliation that does not exist;
- make deceptive, misleading or unlawful content, including false claims about products, prices or results, or content made to pass as genuine footage of real events;
- use anyone's voice, likeness or name without their consent, or imitate a real person's voice;
- infringe intellectual property, privacy or other rights, or make hateful, harassing, defamatory or sexually explicit content;
- probe, overload, reverse-engineer or work around the limits or the security of the service, or resell it without our written consent.
9. Confidentiality
Each party keeps the other's non-public information confidential, uses it only for this agreement, and shares it only with people and providers who need it and are bound by the same duty. This does not cover information that is public, already known, independently developed, or that the law requires to be disclosed. Your material and your unpublished films are your confidential information.
10. Data protection and subprocessors
We process personal data as described in the privacy policy. For your material we act as your processor, on your instructions; an Enterprise contract includes a data processing agreement. Our providers are listed on the subprocessors page, where we announce changes in advance.
11. Availability and changes to the service
We aim for high availability but do not guarantee uninterrupted or error-free service, and self-serve packs have no service level; Enterprise service levels are agreed in writing. We may improve and change features, but we will not remove a core feature without notice while you hold unexpired frames.
12. Suspension
We may suspend access, in whole or in part, if a payment is not made or is reversed (section 4), if your use breaches section 8 or the law, or to prevent harm to the service, other customers or third parties. Where we reasonably can, we tell you first and give you a chance to fix the problem, and we lift the suspension once it is fixed.
13. Warranties
We provide Candela with reasonable care and skill. Beyond that, and to the extent the law allows, the service and the output are provided “as is”, without any other warranty, express or implied, including fitness for a particular purpose and non-infringement.
14. Liability
Our total liability under or in connection with these terms is limited to the fees you paid in the twelve months before the event giving rise to the claim. We are not liable for indirect or consequential loss, lost profit or revenue, loss of data you could have restored from your own copies, or damage to reputation. Nothing in these terms limits or excludes liability that Swiss law does not allow to be limited, in particular for unlawful intent or gross negligence (art. 100 Swiss Code of Obligations) or for personal injury.
15. Indemnity
You will defend us and hold us harmless against third-party claims, and the resulting damages and reasonable costs, that arise from your material, from the films you publish or from a breach of section 6 or 8. We tell you of such a claim promptly and let you control its defence.
16. Term, termination and your data
- These terms apply for as long as the organisation exists. An owner can end them at any time by deleting the organisation in Candela, under Your account; unused frames are not refunded. We can end them with 30 days' notice, or at once if you materially breach them and do not remedy the breach within 14 days of our notice.
- Before deleting it, an owner can export all of the organisation's data, films and files included, as one zip file. Deleting the organisation removes it and everything in it at once; deleted data leaves our backups within 12 months. If we end the terms, the data stays under the normal retention periods (films 180 days after their last activity) until an owner deletes it. Billing records are kept as Swiss law requires.
17. Changes to these terms
We may change these terms with at least 30 days' notice to the organisation's owners, in the app or by email. If you do not accept a change, switch auto-renewal off and stop using Candela before it applies. Changes required by law may apply sooner.
18. Law, courts and language
These terms are governed by Swiss law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). The courts of Genève, Switzerland, have exclusive jurisdiction. The English version prevails over any translation.
19. Online, or by contract
Everything these terms cover is done online, in Candela: buying frames, auto-renewal, invoices, exports and deleting the organisation; questions go to Help in Candela. We send notices to the organisation's owners, in the app or by email. Anything beyond these terms is agreed in a signed Enterprise contract, which names its own contacts.
